1. Overview and Acceptance
These Terms of Service (the "Terms") govern the use of the software provided here by House Duck (an individual developer team) (the "Operator") — the mobile game Quirky Ball (the "Software"). The Operator is an individual developer team, not a company or business entity.
By downloading, installing, launching, or using the Software, you agree to these Terms and the Privacy Policy. If you do not agree, you may not use the Software.
2. The Service
The Software is a free mobile puzzle game that includes the following features:
- Ad-based monetization — rewarded and interstitial ads (Google AdMob)
- (Optional) Account linking via Google Sign-In and progress sync across devices
- Online leaderboards powered by Supabase
- Gameplay using virtual currency such as stamina and gems
3. Age Requirement
The Software may only be used by persons aged 14 or older. Where local law requires a higher minimum age, that age applies. If we learn that a user is below the applicable age, we may delete the related account and data.
4. Accounts
- You can play as a guest without any sign-up; in that case a guest identifier (UID) is generated on your device and the server.
- Linking a Google account lets you sync your progress across devices. Linking is optional.
- Guest account data cannot be recovered once the app is deleted. You are responsible for managing your account and progress data.
5. Virtual Currency (Stamina & Gems)
- Stamina and gems are virtual currencies granted free of charge in the game or earned by actions such as watching rewarded ads.
- Virtual currency has no cash or real-world value and cannot be refunded, transferred, or exchanged.
- Virtual currency is stored only on your device and is lost when you delete the app, delete your account, or the service ends.
- The Operator may adjust how virtual currency is earned or spent to keep the game balanced.
6. Advertising and Consent
- The Software displays ads served by Google AdMob; watching rewarded ads is optional.
- Users in regions where consent is required (such as the EEA and the UK) are shown a Google UMP consent flow on first launch and can change or withdraw consent at any time in the Settings screen.
- Data processing related to ads is governed by the Privacy Policy.
7. Leaderboards
- Leaderboards publicly show your nickname/display code, best score, and country to other users.
- Leaderboard data is stored on Supabase servers, and entries are kept for the most recent 7 days only.
- The Operator may remove inappropriate nicknames or abnormal scores from the leaderboards at its discretion.
8. Prohibited Conduct
You must not:
- Manipulate the game using cheats, automation tools, or modified clients
- Reverse engineer, copy, or redistribute the Software (except as permitted by applicable law)
- Attack or overload the servers or leaderboard systems
- Use nicknames that defame or offend others
- Violate applicable laws
In case of violations, the Operator may restrict use, remove leaderboard entries, or delete accounts.
9. Intellectual Property
All intellectual property rights in the Software belong to the Operator. The Operator grants you only a non-transferable, non-exclusive license for personal, non-commercial use.
10. Disclaimer of Warranties
The Software is provided free of charge by an individual developer team, "as is". The Operator makes no express or implied warranties, including merchantability, fitness for a particular purpose, error-free operation, or uninterrupted availability.
11. Limitation of Liability
To the extent permitted by applicable law, the Operator is not liable for indirect, incidental, or consequential damages (including data loss or loss of expected profits) arising from the use or inability to use the Software. This does not apply in cases of intent or gross negligence by the Operator.
12. Changes and Interruption of Service
As an individual developer team, the Operator may change features of the Software or discontinue providing it, for example for updates, maintenance, or technical reasons. We will make reasonable efforts to announce material changes through an in-app notice or the website.
13. Account Deletion and Data
- You can delete your account at any time via Settings → Delete Account in the app.
- Deletion permanently removes all game data stored on the server and your device (progress data, leaderboard records, Google account linkage, etc.) and cannot be undone. Virtual currency and settings stored only on your device are also lost.
- If you cannot access the app, you can request deletion by email with your nickname and display code. See the Account Deletion page and the Privacy Policy for details.
14. Changes to These Terms
These Terms may be updated to reflect legal changes or service improvements. Material changes will be announced in advance through an in-app notice or this page. Continued use after a change takes effect constitutes acceptance of the updated Terms.
15. Governing Law and Contact
These Terms are governed by the laws of Germany (the Operator's place of residence). Mandatory consumer protection provisions of your country of residence remain unaffected where applicable.
