1. Overview and Acceptance
These Terms govern Quirky Ball, provided by Junhee Choi under the name House Duck in Germany.
Use of the game requires acceptance of these Terms. The shared Privacy Policy is a notice explaining personal-data processing; acknowledging it is not blanket consent to that processing. A required checkbox acknowledging acceptance of the Terms and receipt of the Privacy Policy does not replace separate optional consent required for advertising, analytics, or other processing.
2. The Service
Quirky Ball is an advertising-supported mobile puzzle game for Android and iOS. It includes:
- Ad-based monetization — rewarded, interstitial, banner, and native ads (Google AdMob)
- Optional account linking through Google Sign-In on Android or Sign in with Apple on iOS
- Supabase-backed guest accounts/authentication, game-state synchronization, online rankings/social features, purchase entitlements/reward state, and first-party operational analytics
- Friends and gifts, mailbox, and profile/marble customization
- Gameplay using virtual currency such as stamina and gems
The game offers optional one-time purchases, including Remove Ads, the Starter Package, and the yakwon Package.
3. Age Requirement
Scope of the new controls: the new controls described below apply only to an app that displays both age confirmation and the combined analytics notice. As of September 9, 2026, this change is being prepared for release; this is not a claim that it is already available in the existing public Quirky Ball 1.1.2 (build 53). Check the notice displayed in the app, not the version number alone.
In an app displaying the new notice, users cannot enter the game before confirming they are at least 14 (unknown age: 0), or if they are under 14. Users aged 14–17 can play, but ad SDK/Google UMP requests and optional usage analytics are disabled. Users aged 18 or over can proceed to the standard advertising-consent flow after accepting the required terms; ads are not requested without the required consent. Users select their birth year and month on the age-confirmation screen; the age band is calculated only on the device. The day of birth is not requested, and the selected year/month is not saved or transmitted. Because the day is unknown, the age-14 and age-18 thresholds are conservatively treated as met only from the month after the relevant birth month. Only the calculated band is stored locally (0: unknown, 14: ages 14–17, 18: age 18 or over). This does not replace identity/age verification or any required parental authorization.
The Software may only be used by persons aged 14 or older. Any higher minimum age required by local law for playing the game itself must also be met. If we learn that a user is under 14, we may delete the related account and data.
A minor’s contractual capacity and any need for approval by a parent or other legal representative are governed by applicable law. Where legally required, that approval must be obtained for accepting these Terms and using the game. The age for independently consenting to personal-data processing and requirements for parental authorization vary by jurisdiction and processing purpose and are separate from the minimum gameplay age. These data-consent ages do not mean that all gameplay by persons under 16 is prohibited in Germany.
4. Accounts
- You can play as a guest without any sign-up; in that case a guest identifier (UID) is generated on your device and the server.
- On Android, Google Sign-In can be used for optional account linking and progress synchronization; on iOS, Sign in with Apple provides the corresponding account-linking option.
- Guest account data cannot be recovered once the app is deleted. You are responsible for managing your account and progress data. This explanation of data loss does not limit purchase-restoration or refund rights under law or store policy, or the Operator’s legal obligations.
5. Purchases and Virtual Items
- Remove Ads: a restorable one-time product that removes ads and permanently unlocks speed play.
- Starter Package: a one-per-account package containing one profile icon, one profile frame, three nickname changes, and three country/faction changes. Its exact contents are shown in the app or store before purchase.
- yakwon Package: a one-per-account, restorable profile icon and marble skin entitlement.
- Starter Package contents are granted once per account; used components are not replenished by restoring a purchase.
- Payments are processed through Google Play Billing on Android and App Store/StoreKit on iOS. The store displays price, tax, and payment terms.
- Minors must obtain approval from a parent or other legal representative for paid purchases where required by applicable law. This clause does not impose additional liability on the representative or waive a minor’s statutory rights.
- Restorable entitlements require the same store account. Android uses Google Play purchase status; iOS provides an App Store restore-purchases option.
- Refunds and withdrawal rights follow store rules and mandatory consumer law; statutory rights are not limited.
- When a refund, cancellation, or chargeback is confirmed, the Operator may revoke entitlements such as ad removal or cosmetics and reasonably adjust remaining tickets or change rights granted by that purchase. If granted items have already been consumed, further delivery or restoration may be restricted.
- If objective evidence shows repeated purchase-use-refund cycles, duplicate compensation claims for the same transaction, false unauthorized-payment reports, or similar abuse, the Operator may investigate and proportionately restrict purchasing or social features, temporarily suspend the account, or terminate it in serious cases. The user may contact support about the decision and its basis and request a review.
- A legitimate refund request, a genuine unauthorized or minor purchase report, or the exercise of mandatory consumer rights is not by itself grounds for a sanction.
- Stamina and gems are virtual currencies granted free of charge in the game or earned by actions such as watching rewarded ads.
- Virtual currency has no cash or real-world value and may not be transferred or exchanged outside the store. This does not limit refunds or restoration rights required by mandatory law or store policy.
- Virtual currency and some progress may be stored and synchronized on the device and in server account state. They are lost when the account is deleted or the service ends and cannot be restored. This explanation does not exclude purchase-restoration or refund rights under law or store policy.
- The Operator may adjust how virtual currency is earned or spent to keep the game balanced, subject to applicable law and Section 12. Statutory consumer rights and purchase-restoration or refund rights under law or store policy remain unaffected.
6. Advertising and Optional Analytics Consent
- The Software displays ads served by Google AdMob; watching rewarded ads is optional. Declining advertising consent does not prevent gameplay, but rewards conditional on completing an ad view may be unavailable.
- The Firebase-only notice and setting in the existing public Quirky Ball 1.1.2 (build 53) control Firebase Analytics, not first-party analytics stored in Supabase. A previous Firebase-only ON choice does not retroactively extend to the new combined scope; a fresh explicit choice on the new notice is required.
- In an app displaying the new notice, the optional usage-analytics choice jointly controls House Duck behavioral analytics stored in Supabase and Firebase Analytics (including automatically collected events and tutorial completion). Users aged 18 or over make an explicit choice that is not preselected, separate from required terms acceptance and advertising consent. Declining does not restrict the game. Essential account, currency, transaction, and security processing is separate.
- Declining optional usage analytics does not restrict the game, its features, or rewards. The analytics choice can be changed or withdrawn at any time in the app settings.
- The optional usage-analytics choice is separate from advertising consent through Google UMP and the iOS ATT choice.
- Users in regions where consent is required (such as the EEA and the UK) may be shown a Google UMP consent flow. Advertising choices can be managed through the UMP flow and device settings.
- Data processing related to ads and analytics is governed by the Privacy Policy.
7. Leaderboards and Social Features
- Leaderboards publicly show your nickname/display code, best score, and country to other users.
- Leaderboard data is stored in Supabase. The normal retention threshold is 28 days; record-specific timestamps and the next daily cleanup follow section 6 of the Privacy Policy.
- Inappropriate nicknames or abnormal scores may be removed from leaderboards on verifiable facts and proportionately, with review through support where possible.
- Social features may show your chosen nickname, country, best score, tier, and profile customization to other users. Friend requests, relationships, and gift status are stored on the server to provide those features.
Leaderboard removal, nickname measures, or social-feature restrictions are based on verifiable facts and applied proportionately to the violation. Where possible, we give reasons and an opportunity to request review through support. A legitimate refund or rights request is not abuse by itself.
8. Prohibited Conduct
You must not:
- Manipulate the game using cheats, automation tools, or modified clients
- Reverse engineer, copy, or redistribute the Software (except as permitted by applicable law)
- Attack or overload the servers or leaderboard systems
- Use nicknames that defame or offend others
- Violate applicable laws
Where a violation is established, the Operator may restrict use or particular features, or remove leaderboard entries, based on the facts and proportionately. Account deletion is used only where necessary; where possible, reasons and an opportunity for support review are provided. Exercising legal rights is not grounds for a sanction.
9. Intellectual Property
Intellectual-property rights in the Software belong to the Operator or relevant third-party licensors. The Operator grants only a non-transferable, non-exclusive license for personal, non-commercial use. Exceptions permitted by applicable law remain unaffected.
10. Statutory Conformity and Rights
Statutory requirements for conformity of digital products and the remedies arising from them, as well as other mandatory rights, remain unaffected. These protections take precedence also in cases of account or data loss, entitlement adjustments, restrictions or account termination, service discontinuation, and game-balance changes. Recovery or restoration limitations elsewhere in these Terms do not exclude purchase-restoration or refund rights under law or store policy.
Where applicable, you may request remedies for defective digital products, including correction, a price reduction or termination, and necessary security updates. Store refund procedures are not the only route for exercising statutory rights; requests concerning the Operator’s responsibilities may be sent to support@houseduck.in. Statutory withdrawal rights do not automatically expire merely through downloading, use, or these Terms.
11. Limitation of Liability
Liability is unrestricted for intent, gross negligence, injury to life, body, or health, and any liability that cannot be limited by law. For ordinary negligence, liability for breach of essential contractual duties may be limited, to the extent permitted by law, to foreseeable damage typical for the contract. Otherwise liability is limited to the extent permitted by law.
12. Changes and Interruption of Service
Changes or discontinuation for updates, maintenance, or technical reasons are subject to applicable law, including the requirements of German Civil Code Section 327r where applicable. Where required, this includes valid reasons, no additional cost, clear notice, information on a durable medium, and statutory termination or refund rights for impairment.
13. Account Deletion and Data
- You can delete your account at any time via Settings → Delete Account in the app.
- In-app deletion removes the account profile, current synchronized state, and social connections and cannot be undone. Some raw play and archived records may remain under the 28-day calculation and daily cleanup in section 6 of the Privacy Policy. Device-only settings can be deleted separately.
- Transaction records controlled by Apple or Google and minimal records needed for legal obligations, payment/refund handling, fraud prevention, or legal claims may remain until those purposes end.
- If you cannot access the app, you may request deletion by email. Nicknames and display codes may be visible to other users and are not authentication. Do not send passwords or full payment details. If needed, we will explain the minimum additional information required to process the request. See the Account Deletion page and Privacy Policy.
14. Changes to These Terms
These Terms may be updated to reflect legal changes or service improvements. Material changes will be announced in advance through an in-app notice or this page. Continued use alone is not automatic agreement to all changes or optional personal-data processing. Changes requiring separate consent by law require that consent; rights under applicable law and mandatory consumer protections are not waived.
15. Governing Law and Contact
These Terms are governed by the laws of Germany (the Operator's place of residence). Mandatory consumer protection provisions of your country of residence remain unaffected where applicable.
